Dies wird gerade unter dem Stichwort “Staatstrojaner” heiß diskutiert.

zu (2) Skimming

Mit Beschluss vom 6.7.2010 hat der BGH entschieden (vgl. GWR 2010, 555), dass “Skimming” kein Ausspähen von Daten i.S.d. § 202a StGB ist, da das bloße Auslesen des Magnetstreifens nicht das Tatbestandsmerkmal “Überwindung einer Zugangssicherung” erfüllt.

zu den klassischen Betrugsfällen, die über das Internet abgewickelt werden gesellt sich in den letzten Jahren vermehrt die Betrugsmasche, bei der eine verlockende Mietwohnung auf Portalen wie immobilienscout24, immowelt oder den Online-Portalen von Zeitungen inseriert wird.

Der vermeintliche Vermieter meldet sich zumeist auf Englisch aus dem Ausland. Leider könne er persönlich die Wohnung nicht übergeben Immobilienscout24 kümmere sich aber darum. Den Schlüssel erhält man Zug-um-Zug mit Übergabe von 1000 € Kaution an den DHL-Boten.

Of course I would need a deposit as well of 1000 Euro, which you would get back when you move it or whenever I feel like I can completely trust you.

As I said, the total price which you’ll have to pay for one month of rent will be 450 Euro + The Kaution(The security deposit) 1000 Euro. The total sum is 1450 euro.
I hope you agree that it’s a very reasonable offer, and I don’t rent this flat for big profits.
In order to view the flat and settle a deal, you will need the keys, and the contract.
Since I am unable to come to Germany personally, I’ve hired a major real estate agency ,specialized in international rentals, to represent me.

They are ImmobilienScout24 and i think you might heard about them.
This agency will help you inspect the flat, and handle the payments and documents.

Here’s how it works :
1 – To start the process all I need is your full shipping info(full name, address).
2 – I will go to the ImmobilienScout24 office to drop off the keys and documents of the flat, along with the contract.
3 – ImmobilienScout24 will verify he documents, and send you an invoice (rechnung).
4 – At this point you’ll have to pay the kaution (1000 EURO) as a security deposit + the Rent for one month to ImmobilienScout24, according to the instructions from the invoice.
This will be a guarantee that they don’t send an agent all the way to Germany for a nothing. The deposit will be only a temporary guarantee,
and will not obligate you to renting the flat.
The money will remain in the custody of ImmobilienScout24 until you have checked the flat and confirmed that everything is ok.
5 – After you pay the deposit, and send them the details, ImmobilienScout24 will send an agent to Germany in the next 24-48 hours (Monday to Friday)
to meet you and help you inspect the flat. You can choose the date and time of inspection, to fit your schedule .
6 – If you will be satisfied with the flat, you will sign a copy of the contract .

However, if you are not pleased with the apartment for any reason, the ImmobilienScout24 agent will give you the money back on the spot, and I will get my keys and documents back.

I will pay for the services of the agency, so there will be no extra costs for you.
Also, in case you have another apartment right now, and you cannot move out immediately, we can arrange the deposit and inspection now, and consider the flat reserved for you. You will move in when you are ready and pay the first rent then.
